How to use AI-generated content without violating copyrights

With the development of artificial intelligence (AI) technologies, the issue of copyright on AI-generated content has become increasingly relevant. IT professionals, companies developing AI-based products, as well as content creators and users of such technologies, need to understand the importance of adhering to intellectual property laws. To prevent copyright violations, experts have developed a set of recommendations to help create and use innovations with AI while respecting intellectual property rights.

Who can benefit from the recommendations?

These guidelines will be useful to various groups of users, including:

  • IT professionals and companies involved in developing AI-based products.
  • Content creators, such as authors, artists, photographers, videographers, sound engineers, and other rights holders who create original content.
  • Users of AI systems who generate images, text, videos, and other media using artificial intelligence.
  • Lawyers and intellectual property experts, who provide consultations and legal support in this field.

Content of the recommendations

The recommendations are designed to help interested parties properly interact with AI-generated content and avoid copyright violations. They include advice on:

  • Ownership rights to AI-generated content.
  • How to use AI-generated results without infringing intellectual property rights.
  • Determining responsibilities for AI developers and users.
  • Licensing principles for content and potential restrictions on the use of materials created with AI.

These recommendations will help ensure that the process of creating and using AI-generated content is legal, following intellectual property regulations, which in turn will help avoid legal issues and support the effective development of innovations in this field.

They were developed by representatives of the Ministry of Economy of Ukraine, the Ministry of Digital Transformation, the Expert and Consultation Committee on AI Development at the Ministry of Digital Transformation, and other governmental and private organizations. These include the Ukrainian National Intellectual Property and Innovation Office, IT Ukraine, the Ukrainian Bar Association (UBA), CEDEM, the Department of Intellectual Property and Information Law at the Law Faculty of Taras Shevchenko National University of Kyiv, the Scientific Research Institute of Intellectual Property, IAB Ukraine, and the VRK. This project is part of the “Support for Digital Transformation” program, funded by USAID (US Agency for International Development) and UK Dev. The project partner is the Eastern Europe Foundation.

The author team behind these recommendations provides a detailed overview of the key aspects of using AI while considering legal standards and potential risks of copyright violations.

The use of AI technologies in content creation has vast potential, but also comes with new legal challenges. Applying the recommended approaches will help safeguard intellectual property rights and contribute to the development of digital technologies in Ukraine in line with international standards.
