New rules for patent and utility model registration in Ukraine

Starting from October 25, 2024, new rules for patent and utility model registration have been implemented in Ukraine, approved by the Ministry of Economy under the order dated September 9, 2024, No. 23301. These changes aim to make the process of registering innovations faster, more transparent, and better aligned with the needs of both Ukrainian and international inventors.

Advantages of the new rules

Deputy Minister of Economy of Ukraine Vitaliy Kindrativ noted that the new rules reaffirm Ukraine’s commitment to remain at the forefront of technological progress and innovation. Sectors such as “green energy,” transport technologies, nanotechnology, biotechnology, and defense will receive priority in the review of applications. Specifically, the new rules facilitate the digitalization of the application examination process, thus speeding up the registration of rights.

  • Clear delineation of the rights and responsibilities of applicants.
  • A list of required documents and details of the examination process.
  • Special focus on international applications and applications in sensitive areas.
  • Possibility for partial waiver of rights and new mechanisms for objections and appeals from third parties.

Definition of invention and utility model

An invention or utility model is a new technical solution that addresses current challenges across various fields. For registration, it is essential that the invention meets the requirements of industrial applicability and inventiveness. Utility models must comply with novelty and applicability criteria.

Compliance with euro-integration standards

The new rules align with EU standards and take into account the provisions of the Acquis communautaire, facilitating Ukraine’s integration into the European innovation community. They also consider Ukrainian sanctions legislation: applications are checked for compliance with sanctions norms, and in cases of imposed sanctions, further review is conducted in line with the restrictions set by the National Security and Defense Council of Ukraine.
